Terms of Service

Welcome to Avant-Garde Sports. These Terms of Service govern your use of our website (avantgardesports.com) and the manufacturing services provided by Avant-Garde Sports, located at Small Industrial Area, Shahabpura Road, Sialkot, Pakistan.

By placing an order or submitting a quote request, you (the Client) agree to be bound by these Terms.

1. Custom Orders & Specifications

  • Specifications: The Client is responsible for providing accurate product specifications, design files, sizing requirements, and material details. Avant-Garde Sports is not responsible for errors resulting from incorrect specifications provided by the Client.
  • Sample Approval: For all custom orders, we will produce a pre-production sample. Bulk production begins only after the Client approves the sample in writing. Any changes requested after sample approval may incur additional costs and extend lead times.

2. Payment Terms

  • Deposit: A non-refundable deposit (typically 30% of the total order value) is required before production commences and materials are purchased.
  • Balance: The remaining balance must be paid in full prior to or upon shipment from our factory.
  • Methods: We accept payments via Bank Transfer (TT) or other methods agreed upon in the invoice.

3. Production & Lead Times

  • Estimates: Lead times provided are estimates based on current factory capacity and material availability. While we strive to meet all deadlines, delays due to material shortages, shipping disruptions, or force majeure events may occur.
  • Rush Orders: Rush production may be available for an additional fee, subject to factory capacity, and must be confirmed in writing before production begins.

4. Shipping & Customs

  • Incoterms: Unless otherwise agreed in writing, terms are EXW (Ex Works) or FOB (Free on Board) Sialkot.
  • Duties & Taxes: The Client is the importer of record and is solely responsible for all import duties, VAT, taxes, and customs clearance in their destination country. Avant-Garde Sports is not liable for delays caused by customs authorities.

5. Quality Control & Tolerances

  • Manufacturing Tolerance: Due to the nature of sports goods manufacturing, a measurement tolerance of +/- 0.5 to 1 cm is considered an acceptable industry standard and does not constitute a defect.
  • Material Variations: Slight variations in color, texture, or material properties may occur between production batches or between digital samples and physical products. We strive to minimize variation and adhere to approved samples.

6. Returns & Defect Policy

  • Custom Goods: As all products are manufactured to your specific requirements, we do not accept returns or provide refunds for change of mind.
  • Defect Claims: If you receive items with verified manufacturing defects, you must notify us within 7 days of receiving the shipment with photographic evidence and a written description.
  • Resolution: If the defect is confirmed as a manufacturing error, Avant-Garde Sports will, at its discretion, either remake the defective items or provide a credit for those specific items.

7. Intellectual Property

  • Client Ownership: The Client retains full ownership of their logos, designs, and specifications. Avant-Garde Sports will not sell or distribute Client-branded products to third parties without written permission.
  • Portfolio Use: Avant-Garde Sports reserves the right to use photos of finished products in our portfolio or website to demonstrate manufacturing capabilities, unless the Client requests a Non-Disclosure Agreement (NDA) in writing.

8. Limitation of Liability

Avant-Garde Sports’s liability in connection with any order is limited to the value of that specific order. We are not liable for indirect, consequential, or incidental damages arising from the use or inability to use our products.

9. Governing Law

These Terms are governed by the laws of Pakistan. Avant-Garde Sports and the Client agree that the courts of Sialkot, Pakistan shall have jurisdiction to resolve any dispute arising from these Terms or any manufacturing agreement.
